# GENERAL TERMS AND CONDITIONS
## 1. General Provisions
### 1.1
These General Terms and Conditions (hereinafter referred to as the "GTC") set out the contractual terms governing accommodation services provided by **Takler Kúria és Panzió**, operated by **Takler Kúria Kft.** (registered office: H-7100 Szekszárd, Bem utca 13, Hungary; hereinafter referred to as the "Service Provider"). These terms apply to all accommodation agreements concluded between the Service Provider and its Guests.
### 1.2
Individual agreements are not considered part of these General Terms and Conditions. However, they do not exclude the possibility of entering into separate agreements with travel agencies, tour operators or other business partners under specific terms and conditions applicable to the respective business relationship.

# 2. Contracting Parties
### 2.1
The accommodation and related services are provided to the Guest. Where the Guest submits a reservation directly to the Service Provider, the Guest shall be deemed the Contracting Party. Upon confirmation of the reservation by the Service Provider, the Guest and the Service Provider shall become contractual parties (hereinafter jointly referred to as the "Parties").
### 2.2
Where the reservation is submitted on behalf of the Guest by a third party (hereinafter referred to as the "Agent"), the contractual relationship between the Service Provider and the Agent shall be governed by the agreement concluded between them. In such cases, the Service Provider shall not be obliged to verify whether the Agent is duly authorised to represent the Guest.

# 3. Reservation Procedure and Conditions of Service
### 3.1
Following a verbal or written enquiry from the Guest, the Service Provider shall provide a written offer. If no written reservation is received within 48 hours of the offer being sent, the Service Provider's offer shall expire automatically.
### 3.2
The accommodation agreement shall become effective only upon written confirmation by the Service Provider of the Guest's written reservation. Such confirmation shall constitute a written contract.
### 3.3
Reservations, agreements or amendments made verbally, including verbal confirmations by the Service Provider, shall not constitute a binding contract.
### 3.4
Accommodation agreements shall be concluded for a fixed period.
### 3.5
If the Guest permanently vacates the room before the agreed departure date, the Service Provider shall be entitled to charge the full accommodation fee specified in the agreement. The Service Provider reserves the right to resell any room vacated prior to the agreed departure date.
### 3.6
Any extension of the Guest's stay is subject to the prior approval of the Service Provider. The Service Provider may require payment for services already rendered before approving such an extension.
### 3.7
As required by applicable Hungarian law, all Guests must present valid identification prior to check-in. No person may stay at the hotel without being properly registered.
### 3.8
Any amendment or supplement to the accommodation agreement shall be valid only if made in writing and signed by both Parties.

# 4. Check-in and Check-out
### 4.1
Rooms are available for check-in from **3:00 p.m.** on the agreed arrival date.
### 4.2
Unless a later arrival time has been agreed in advance, the Service Provider reserves the right to cancel the reservation if the Guest fails to arrive by **6:00 p.m.** on the scheduled arrival date.
### 4.3
Where a deposit has been paid, the reserved room(s) shall remain available until **11:00 a.m.** on the day following the scheduled arrival date.
### 4.4
Guests are required to vacate their rooms by **11:00 a.m.** on the day of departure.
### 4.5
Subject to availability, early check-in and late check-out may be arranged for an additional charge. Guests wishing to use either service are kindly requested to contact the hotel reception prior to arrival.

# 5. Extension of Stay
### 5.1
Any extension of the Guest's stay is subject to the prior approval of the Service Provider.
### 5.2
If the Guest fails to vacate the room by **11:00 a.m.** on the agreed departure date and no extension has been approved by the Service Provider, the Service Provider shall be entitled to charge the room rate for an additional night. In such case, the Service Provider's obligation to provide accommodation services shall simultaneously cease.
# 6. Prices
### 6.1
The current hotel rates are available on the hotel's website and at the hotel reception. Price lists for additional services are available at the relevant hotel departments.
### 6.2
The Service Provider reserves the right to modify its published prices without prior notice (for example, due to package offers or other discounts). If the Guest has made a reservation and the Service Provider has confirmed it in writing, the Service Provider may not subsequently change the confirmed accommodation rate. ### 6.3
The Guest may request information regarding the prices of services from the hotel reception prior to the commencement of the service.
### 6.4
When publishing its prices, the Service Provider indicates the legally applicable tax rates (VAT, local tourism tax) valid at the time of the offer. Published prices include VAT as required by law but do not include the local tourism tax, which must be paid on site. The Service Provider reserves the right to pass on any additional costs resulting from changes in applicable tax legislation (VAT, local tourism tax) to the Contracting Party, following prior notification.
### 6.5
The Service Provider reserves the right to change prices at any time.

# 7. Offers and Discounts
### 7.1
Current offers and discounts are published on the hotel's website. Published discounts apply exclusively to individual room reservations.
### 7.2
Published discounts cannot be combined with any other discounts or special offers.
### 7.3
For reservations involving products subject to special conditions, group bookings or events, the Service Provider shall establish individual terms and conditions, which shall be included in a separate agreement.

# 8. Children's Discounts
### 8.1
The following accommodation discounts are available for children staying in the same room as their parents:
* Children aged 0–3 years: 100% discount
* Children aged 3–12 years: 50% discount on the extra bed rate
* Children aged 12–16 years: extra bed fee applies according to the applicable rate
### 8.2
Extra beds are available only in certain room types.
### 8.3
Requests for extra beds must be agreed with the Service Provider in advance, at the time of booking.

# 9. Cancellation Policy
### 9.1
Unless otherwise specified in the hotel's offer, the following cancellation and modification conditions apply:
Cancellations without penalty are possible up to the 10th calendar day prior to arrival, exclusively in writing by e-mail.
For cancellations made between 3 and 10 days prior to arrival, a cancellation fee of 50% of the total accommodation fee shall be charged.
For cancellations made within 72 hours prior to arrival, a cancellation fee of 100% of the total accommodation fee shall be charged.
An invoice for the cancellation fee shall be issued and sent by bank transfer payment request with an 8-calendar-day payment deadline.
If the Contracting Party is a legal entity or organisation (including companies, associations, churches, municipalities, municipal institutions, state organisations and their institutions, etc.), the Contracting Party/Client shall be responsible for payment of the applicable cancellation fee, even if the accommodation costs would otherwise have been paid directly by the Guest.
### 9.2
If the Contracting Party has secured the accommodation services by advance payment and fails to arrive on the scheduled arrival date (and no written cancellation has been received), the Service Provider shall enforce the full amount of the paid deposit as a cancellation fee.
In such cases, the Service Provider shall keep the accommodation available for the Contracting Party until 11:00 a.m. on the day following the scheduled arrival date. After this time, the Service Provider's obligation to provide accommodation services shall cease.
### 9.3
If the Contracting Party has not secured the accommodation services by advance payment, credit card guarantee or another method specified in the agreement, the Service Provider's obligation to provide accommodation shall cease after 6:00 p.m. local time on the scheduled arrival date.

# 10. Payment Methods and Guarantees
### 10.1
Payment for ordered services may be made on site:
* in cash (Hungarian Forints or Euros),
* by bank card accepted by the Service Provider,
* or by bank transfer.
### 10.2
In the case of payment by bank transfer, unless otherwise agreed with the Service Provider, the Guest shall transfer the payment for the ordered services to the hotel's bank account before the scheduled arrival date, ensuring that the amount is credited to the hotel's account by the date of arrival.
Alternatively, the Guest may provide an irrevocable confirmation issued by their bank proving that the transfer has been completed.
### 10.3
Individual room reservations may be guaranteed by providing valid credit card details or by paying an advance deposit.
Other payment methods accepted on site include:
* OTP Széchenyi Recreation Card (SZÉP Card)
* MKB Széchenyi Recreation Card (SZÉP Card)
* K&H Széchenyi Recreation Card (SZÉP Card)
* vouchers issued by the hotel and/or its contracted partners
# 11. Refusal of Contract Performance and Termination of Service Obligations
### 11.1
The Service Provider shall be entitled to terminate the accommodation agreement with immediate effect and refuse to provide services if:
* the Guest uses the room or the facilities provided in an improper manner or not for their intended purpose;
* the Guest fails to vacate the room by 11:00 a.m. on the departure date indicated at check-in and has not received prior approval from the Service Provider for an extension of stay;
* the Guest behaves in an objectionable, aggressive or unacceptable manner towards the safety, order, operation of the accommodation facility or its employees, or is under the influence of alcohol or drugs, or displays threatening, offensive or otherwise inappropriate behaviour;
* the Guest suffers from an infectious disease;
* the Contracting Party fails to fulfil its obligation to pay the required advance payment by the agreed deadline.
### 11.2
If the agreement between the Parties cannot be fulfilled due to force majeure circumstances, the agreement shall terminate.

# 12. Accommodation Guarantee
### 12.1
If the hotel operated by the Service Provider is unable to provide the services specified in the agreement due to reasons attributable to the Service Provider (for example, overbooking, temporary operational difficulties, etc.), the Service Provider shall immediately arrange alternative accommodation for the Guest.
### 12.2
The Service Provider shall provide or offer the services specified in the agreement, at the confirmed price and for the agreed period, at another accommodation facility of the same or higher category until the obstacle preventing performance has ceased.
All additional costs arising from providing alternative accommodation shall be borne by the Service Provider.
### 12.3
If the Service Provider fully fulfils its obligations under this section, the Contracting Party shall not be entitled to make any subsequent claim for compensation.

# 13. Rights of the Guest
### 13.1
By entering into an accommodation agreement, the Guest becomes entitled to use the rented premises in accordance with their intended purpose, as well as to use the facilities normally provided by the accommodation establishment for Guests and to receive standard services during the published opening hours.
### 13.2
The Guest may submit complaints regarding the performance of the services provided by the Service Provider during their stay.
The Service Provider undertakes to investigate and handle any complaint submitted in writing during this period (or recorded in an official report by the Service Provider).

# 14. Obligations of the Guest
### 14.1
The Guest is obliged to pay the agreed fee within the deadline specified in the confirmation or, at the latest, upon completion of the accommodation service agreement.
### 14.2
If Guests bring food or beverages into the hotel and consume them in public areas, the Service Provider reserves the right to charge a reasonable service fee (so-called "corkage fee" in the case of beverages).
Taking food or beverages from the hotel's catering facilities outside the hotel is prohibited.
### 14.3
The Guest must obtain prior approval from the Service Provider before using electrical appliances brought into the hotel which are not considered normal travel equipment.
### 14.4
Hotel guests may park their vehicles free of charge in the hotel's parking area, subject to availability.
### 14.5
Traffic regulations must be observed within the parking area.
### 14.6
Guests are requested to dispose of waste in the designated waste bins located throughout the premises and in the rooms.
Furniture, furnishings or textiles owned by the hotel may not be removed from the rooms or the building without the permission of the Service Provider.
### 14.7
Guests may use the equipment and facilities located on the premises solely at their own responsibility and must comply with all displayed operating and safety instructions.
### 14.8
In accordance with Act XLII of 1999 on the Protection of Non-Smokers, the hotel has operated as a non-smoking establishment since 1 January 2012.
Smoking is prohibited in all enclosed areas of the hotel, including guest rooms and common areas.
The hotel has placed the legally required signs informing Guests of this obligation in the relevant areas.
Hotel employees are entitled to warn Guests and any other persons staying on the premises to comply with the law and to cease any unlawful behaviour.
Guests and all persons staying on the premises are obliged to comply with these regulations and follow any such instructions.
If the hotel operator is fined by the competent authority due to unlawful smoking behaviour by a Guest or any other person on the premises, the operator reserves the right to pass on the amount of the fine to the person responsible and demand reimbursement.
In the event of smoking in a guest room, the Service Provider is entitled to charge an additional cleaning fee of HUF 30,000.
Any additional costs arising from activation of the smoke detector may also be charged to the Guest.
### 14.9
In the event of fire, Guests must immediately notify the reception.
In case of fire or any other emergency alarm, Guests must leave their rooms and the hotel's common areas as quickly as possible in accordance with the instructions displayed.
The use of elevators is strictly prohibited in case of fire.
### 14.10
Guests sharing rooms, facilities or equipment of the hotel shall be jointly and severally liable for any damage caused by improper use.
### 14.11
Any fireworks or other activities requiring official permission brought or organised by Guests require the written approval of the hotel and the necessary permits obtained by the Guests.
### 14.12
The Guest is responsible for ensuring that children under the age of 14 remain in the hotel only under adult supervision.
### 14.13
The Guest must immediately report any damage suffered and provide all necessary information required for clarifying the circumstances of the incident, including information required for preparing a police report or initiating official proceedings if necessary.
### 14.14
The Guest expressly acknowledges that the hotel operates a closed-circuit camera system in common areas of the hotel (excluding changing rooms and toilets, but including the car park and outdoor areas directly belonging to the hotel) for security purposes.
Recordings are stored and deleted in accordance with applicable legal regulations.
### 14.15
The Guest (including visitors arriving to see a hotel guest and persons travelling together with the Guest) must use the hotel building and its immediate surroundings appropriately and without unnecessarily disturbing other Guests or visitors.
### 14.16
Upon departure, Guests must return their room cards to reception.
Failure to do so, or loss or damage of the room card, entitles the Service Provider to charge a compensation fee of HUF 1,000 per card, payable by the Guest upon departure.
Room cards may be used to access the room until 11:00 a.m. on the day of departure. After this time, the room card becomes invalid unless an extension of stay has been agreed with the Service Provider.
# 15. Bringing Animals into the Hotel
### 15.1
Pets are not allowed in the hotel.

# 16. Rights of the Service Provider
### 16.1
If the Guest fails to fulfil their obligation to pay for services used or ordered but not used, which are subject to a cancellation fee or other charges, the Service Provider shall have a lien over the personal belongings brought into the hotel by the Guest as security for its claims.
### 16.2
The security service operating continuously on the premises is entitled to check Guests entering and leaving the property, verify their identity and, where justified, inspect vehicles leaving the premises.
### 16.3
If the Guest fails to fulfil their obligation to pay for services used or ordered but not used, which are subject to payment obligations or cancellation fees, the Service Provider shall have a lien over the Guest's personal belongings brought into the hotel in accordance with the Hungarian Civil Code.
The provisions applicable to a landlord's lien shall apply accordingly.
As long as the lien exists, the Service Provider may prevent the removal of the property subject to the lien.
If the property subject to the lien is a vehicle owned by the Guest, the retention of such vehicle shall apply exclusively to the vehicle itself and shall in no way restrict the personal freedom of movement of the Guest or any accompanying persons.
Guests and accompanying persons may leave the hotel premises without any other restrictions.

# 17. Obligations of the Service Provider
### 17.1
The Service Provider shall provide the accommodation and other services ordered under the agreement in accordance with applicable regulations and service standards.
### 17.2
The Service Provider shall investigate written complaints submitted by Guests and take the necessary measures to resolve any issues, recording such actions in writing.
### 17.3
For the comfort and tranquillity of Guests, excessive noise is prohibited after 10:00 p.m. in the hotel premises and on the terrace.
This includes disturbing levels of television volume and music played in guest rooms.
Hotel staff are responsible for ensuring compliance with this requirement.

# 18. Illness or Death of the Guest
### 18.1
If the Guest becomes ill during their stay and is unable to act in their own interest, the Service Provider shall offer assistance in arranging medical care.
### 18.2
In the event of illness or death of a Guest, the Service Provider shall be entitled to reimbursement of costs from the Guest, their relatives, heirs or the person responsible for payment.
Such costs may include medical and administrative expenses, the value of services used prior to death, and any damage caused to equipment or furnishings in connection with the illness or death.

# 19. Data Security and Data Processing
### 19.1
To subscribe to the newsletter available on our website, users are required to provide their name and e-mail address.
By subscribing to the newsletter, the User consents to the processing of their provided personal data.
The Service Provider shall process such data until the User requests its deletion.
### 19.2
Every newsletter contains a direct link allowing users to unsubscribe.
### 19.3
The User shall be responsible for the accuracy and authenticity of the personal data provided.
### 19.4
The Service Provider protects personal data against unauthorised access, alteration, transfer, disclosure, deletion or destruction, as well as accidental loss or damage.
### 19.5
The Service Provider ensures data security in cooperation with the operators of its servers.
### 19.6
Personal data provided by Users may only be accessed by authorised employees of the data controller.
The Service Provider shall not disclose personal data to third parties other than those specified, unless legally required or authorised.
### 19.7
The Service Provider shall not disclose personal data to third parties except with the prior and explicit consent of the person concerned.
### 19.8
The User acknowledges that the Service Provider may be legally obliged to provide personal data to competent authorities if the legal requirements for such disclosure are met.
The User may not object to data disclosure based on legal provisions, official requests or court decisions.

# 20. Liability of the Service Provider
The Service Provider shall be liable for damage suffered by the Guest due to loss of, damage to or destruction of the Guest's belongings only if such belongings were placed in a designated storage area provided by the Service Provider or handed over to an employee whom the Guest could reasonably consider authorised to receive them.
### 20.2
The Service Provider shall not be liable for damages caused by unavoidable circumstances beyond the control of the Service Provider, its employees or Guests, or for damages caused by the Guest themselves.
### 20.3
The Service Provider may designate areas within the premises where Guests are not permitted to enter.
The Service Provider shall not be liable for any damage or injury occurring in such restricted areas.
### 20.4
The Service Provider shall only be liable for valuables, securities and cash if these items were expressly accepted for safekeeping, or if the Service Provider expressly refused to accept them for safekeeping, or if the damage occurred for a reason for which the Service Provider is liable under general legal provisions.
In such cases, the burden of proof shall rest with the Guest.
### 20.5
The Service Provider shall not be liable for damages resulting from improper use.
### 20.6
The Guest must immediately report any damage suffered and provide all information necessary for investigating the circumstances of the incident, including any information required for a police report or official procedure.
### 20.9
The maximum amount of compensation shall be fifty times the daily room rate specified in the agreement, except in cases involving valuables, securities and cash, unless the actual damage is lower.
21. Confidentiality
21.1
During the performance of its obligations under the agreement, the Service Provider shall act in accordance with the applicable legislation regarding the protection of personal data and the disclosure of information of public interest.
22. Force Majeure
22.1
Any event or circumstance beyond the control of either Party (for example: war, fire, flood, extreme weather conditions, power failure, strike or other unavoidable circumstances) shall release the Parties from their obligations arising from the agreement for the duration of such event or circumstance.
23. Place of Performance, Applicable Law and Jurisdiction
23.1
The place of performance shall be the location of the accommodation establishment providing the accommodation services.
23.2
Any disputes arising in connection with the accommodation agreement shall be subject to the jurisdiction of the competent court with both subject-matter and territorial jurisdiction regarding the Service Provider.
23.3
The legal relationship between the Service Provider and the Guest shall be governed by the laws of Hungary.
24. Data of Visitors to Our Website
24.1
When visitors access the website operated by the Service Provider, neither the user's IP address nor any other personal data is recorded.
Browsing the website is possible freely and anonymously.
The Service Provider uses anonymous website visit data exclusively for statistical purposes, for optimising its online presence and improving system security.
The recorded data does not contain any personal information.
24.2
The Service Provider treats all data and information relating to Users confidentially and uses such data exclusively for its own research and statistical purposes.
24.3
The Service Provider shall not be responsible for previously deleted pages that may still appear in internet search engine archives.
The removal of such archived pages shall be the responsibility of the operators of the relevant search engines.
25. Newsletter
25.1
The Service Provider may send online newsletters and electronic direct marketing messages (hereinafter collectively referred to as "Newsletter") containing news, information and offers to persons who subscribe to the newsletters operated by the Service Provider.
Newsletters may be sent several times per month.
26. Privacy Statement
26.1
The Service Provider considers the protection of personal data to be of particular importance in the course of its activities.
All personal data provided to the Service Provider shall be processed in accordance with applicable legislation.
The Service Provider ensures the security of such data, implements the necessary technical and organisational measures, and establishes procedures required for compliance with applicable legal regulations.
During its activities, the Service Provider processes Users' personal data exclusively for the purposes of:

entering into contracts,

invoicing,
-
and its own marketing and promotional activities,
in accordance with applicable data protection legislation.
By entering into an accommodation agreement, the Guest acknowledges that they have read and understood the above terms and conditions and agree to be bound by them.
These General Terms and Conditions may be amended in the future. Any amendments shall be published by the Service Provider on the hotel's website, and the current valid version of the General Terms and Conditions shall also be available at the hotel reception.
